COMPENSATION TO THE AGENCY: WHERE DO FEES STAND AND WHERE DO THEY NOT?

Payment Required


In Canada, staffing firms can bill businesses for the services they provide.

Recruiters are allowed to charge applicants and job-seekers for their services as long as those services are unrelated to the actual recruitment process. Services such as creating a CV and attending a workshop to improve your employability skills are two potential examples of those that could incur fees. A separate written agreement specifying the amount must be in place under these conditions. However, the fee cannot be made a prerequisite for finding employment for the person.

Unlawful Charges


One cannot be charged by a staffing agency for the services it provides in locating employment.

It is illegal for an agency to require or maintain a deposit or bond from a worker, even if the worker is assured a reimbursement.

The staffing firm cannot require the company to seek reimbursement from the worker for agency fees.

IMMIGRATION REPRESENTATIVES AND RECRUITMENT FIRM OPERATORS

Both are common misunderstandings, but knowing the distinctions between them is crucial. To deal with the Refugee Board, the Canada Border Services Agency, or Citizenship and Immigration Canada on behalf of an international worker, that worker must retain the services of an immigration advocate (CIC). A worker's case can only be negotiated with the CIC by an immigration attorney, not by an employment agency. However, Canadian immigration attorneys have no legal standing to help their clients find employment.
